Tyent USA’s Sports Team Contest Terms and Conditions / Twitter Party Rules

By entering and participating in the Tyent Sports Team (“Contest”) entrants agree to accept and be bound by these rules and the decisions of “Tyent USA, LLC” as final in all matters relating to the “Contest”:

SPONSOR: The sponsor of the “Contest” is Tyent USA World Headquarters 137 Hurffville Crosskeys Road  Sewell, NJ 08080 .

ENTRY:  To enter the contest you will need to “Comment” in no more than ten (10) words on the Tyent Sports Team Poster on the Tyent Facebook page (www.facebook.com/tyentusa) and nominate a USA based kids sports team of your choice to Facebook with a brief description of what you’ll use the money for.  You will need to conform with the Entry Content Restrictions set forth below. We suggest you become a fan of our Facebook page (www.facebook.com/tyentusa) to enter. Internet access and an active Facebook account is required to enter the contest. To become a member of Facebook you may go to www.facebook.com to request membership. Membership to Facebook is free. Only one (1) entry per person permitted during the Contest Entry Period.  One (1) prize per winner household only.  Use of any robotic, automatic, programmed or similar entry method or more than one entry during the Contest Entry Period will void all entries and result in disqualification.  TyentUSA reserves the right to disqualify contestants. Contestants shall not enter multiple times or vote for their own entry with a fake Facebook account. Fraudulent activities will be monitored and will lead to exclusion.

 ENTRY CONTENT RESTRICTIONS:

Entries must not contain material that:

References tobacco, smoking or smoking products or alcoholic beverages, or otherwise contains or depicts someone smoking or intoxicated;

Violates or infringes another’s rights, including without limitation, privacy, publicity or intellectual property rights, or that constitutes copyright infringement;

Contains material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;

Contains any unacceptable clothing or adornments, or displays any commercial/corporate advertising other than that of Sponsor (including but not limited to corporate logos, brand names, trademarks, slogans, political, personal and religious statements);

Contains indecent, violent, or unsafe behavior or situations, profanities or obscenities, including but not limited to nudity, or pornography, or is otherwise inappropriate, indecent, profane, obscene, hateful, tortuous, slanderous or libelous;

References persons without their permission;

Contains any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses;

Contains materials embodying the names, likenesses, voices or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without permission;

Contains any statements that promote or oppose a political party or candidate;

Disparages any persons or organizations;

Includes threats to any person, place, business, or group;

Is unlawful, in violation of or contrary to any applicable federal, state, or local laws and regulations.

Without limitation, Sponsor reserves the right in its sole discretion to disqualify any entry that, in Sponsor’s sole opinion, refers, depicts or in any way reflects negatively upon the Sponsor, the Promotion or any other person or entity, does not comply with these Official Rules or if Sponsor receives notification about any potential infringements or breaches of law or any other reason set forth herein.

JUDGING/CONTEST WINNER DETERMINATION:

All eligible entries will be judged by the amount of votes they receive on their Entry Comment on Tyent USA’s Facebook Page.  Tyent USA Facebook fans will be asked to “Like” their favorite entry, the entry with the most Facebook Likes is the Grand Prize winner.  In the event of a tie during judging, tied entries will be re-evaluated and the winner will be chosen at random by Tyent USA.  All prize awards are subject to verification of eligibility.

ELIGIBILITY:

Contest is only open to residents of the United States. You must be at least twenty-one (21) years of age to enter. To enter, you must submit the name of the team and description in no more than ten (10) words in the Comment section of the announcement poster on the official Tyent USA Facebook page. Tyent USA reserves the right to decide which recipients will be eligible. Tyent USA reserves the right to publicly use all or any part of the story submitted in the above form. If no entries are received, then no prizes will be given. The unclaimed prizes may be forfeited or another winner may be chosen, at our discretion. Contest ends at exactly 10:00:00PM (EST) July 30th, 2014.  1 prize per winner only. The winners will be notified by Tyent USA via Facebook and within fifteen (15) days of the close of the contest. Prizes will be distributed within 60 days from close of contest. The decisions of Tyent USA with respect to the contest are final.

PRIZES:

Grand Prize: $500 cash and 1 (one) water ionizer donation from Tyent will be given to the sport organization who receives the most likes for the posted comment described above. Plus, an additional $500 cash will be given to the Tyent Ambassador/Fan with the most likes who nominated the organization and enabled them to get the most likes to win.

Cash prizes will be sent upon Tyent’s discretion in the form of a check.

Winners will be announced after July 30th, 2014 10:00:00PM (EST).

Contest prize is not transferable. Prizes may not be substituted for or redeemed for cash. Tyent USA reserves the right to substitute a prize of equal or greater value if an advertised prize becomes unavailable.

Except where prohibited by law, by participating in the contest, the winner agrees to have their name, voice, or likeness used by Tyent USA in connection with the contest and in any advertising or promotional material relating to this contest without additional signed release document, without financial or other compensation except as specifically provided herein.

Tyent USA shall not be responsible for damage to a prize or loss of a prize after the prize has been shipped to the winner, or for technical or other product failures or malfunctions, or lost, late, misdirected or damaged shipments, or any other error of any kind which may occur in the execution of this contest.

By redeeming the prizes, winner releases Tyent USA, and their respective officers, directors, employees, representatives, licensees, advertising and other agents, of and from any and all claims whatsoever which the winner, the winner’s heirs, estate trustees or other personal legal representatives or assigns, have or may have arising out of or in any way related to this contest and/or the prizes.

Tyent USA, their respective parents, subsidiaries, affiliates, directors, officers, employees, or agents shall be responsible for lost, misdirected, or late entries; or for lost, misdirected, or late confirmation replies.

This contest is not open to employees or immediate family members of Tyent USA, their respective advertising/promotion agencies, parents, subsidiaries, affiliates, directors, officers, employees, and agents.

This offer is void wherever prohibited or restricted by national, state, local or any governmental laws.

Failure to comply with the contest rules may result in the winner’s disqualification, the cancellation of prizes and/or shipment of prizes, at the sole discretion of Tyent USA.

Tyent USA reserves the right in its sole discretion to modify the contest rules and dates at any time for any reason. Material modifications shall be announced online. By participating in this contest, all participants agree to be bound by these contest rules, any modifications thereof, and by all other rules imposed by Tyent USA.

Neither Tyent USA, nor their respective parents, subsidiaries, affiliates, directors, officers, employees, or agents shall have any liability in the event of any cancellation, delay or other event that is outside of their immediate and direct control in connection with this contest.

Copies of the written contest rules and, if required by applicable law, a list of all winners shall be available during regular business hours at Tyent USA, Hurffville Crosskeys Road, Sewell, NJ 08080 or by sending a self-addressed stamped envelope to Tyent USA at the above address.

 

Twitter Party Rules

Official Rules:

NO PURCHASE NECESSARY TO ENTER OR WIN. BY ENTERING THE SWEEPSTAKES, YOU (“ENTRANT” OR “YOU”) MUST AGREE TO THESE OFFICIAL RULES, WHICH CREATE A CONTRACT SO READ THEM CAREFULLY BEFORE ENTERING.

Eligibility – The #alkalinewaterforhealth Twitter Party  is open only to legal residents of the United States, who have a Twitter account, and are eighteen (18) years of age or older at the time of entry who receive an invitation to enter. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Void in Puerto Rico and where prohibited.  If you do not have a Twitter account, it is free to create one at www.Twitter.com.

 Agreement to Official Rules – Participation in this Sweepstakes constitutes Entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to this Sweepstakes. Winning a Prize is contingent upon fulfilling all requirements set forth in these Official Rules.

Submission Entry Period – Entrants may make submissions via Twitter following guidelines outlined in How to Enter (“Entry”) between the hours of 9:00 pm – 10:00 pm ET on July 28, 2914. Date and time can change based on Twitter’s status. If date and time are changed entrants will be notified via Twitter using appropriate hashtag (#alkalinewaterforhealth).  Sponsor’s clock is the Sweepstakes’ official clock. You must be present on Twitter during the Twitter Party.

How to Enter.Enter by RSVPing for the Twitter party and be actively participating in the party by tweeting during the party. To be eligible to win prize(s), entrants must submit a tweet during the Entry Period using #alkalinewaterforhealth hashtag.Sponsor, may disqualify you from the Sweepstakes if it believes, in its sole and absolute discretion that your Submission fails to conform to these Official Rules.

Miscellaneous:   Sponsor reserves the right to change these Official Rules or cancel the Sweepstakes at any time, at its discretion.  In the event of any dispute concerning the identity of any entrant, the entry will be deemed submitted by the natural person who is the authorized holder of the transmitting account. “Authorized account holder” is defined as the natural person who is assigned to a Twitter account by Twitter, who is responsible for assigning all Twitter accounts. Any false information provided within the context of the Sweepstakes by any Entrant concerning identity, mailing address, telephone number, e-mail address, ownership of right or any other non-compliance with these Official Rules or the like may result in the immediate elimination of the Entry from the Sweepstakes.
